Terms of Service for SMS/Text Messaging

These Terms of Service (“Terms”) explain how CC Tree Design, LLC (“CC Tree Design,” “we,” “us,” or “our”) uses SMS/text messaging and how you may interact with us via text. By providing your mobile phone number to us and/or by communicating with us via SMS/text message, you agree to these Terms.
1. Program / Brand Name
Our SMS/text messaging program is operated by CC Tree Design, LLC, a tree service company based in San Francisco, California. All messages you receive under this program are sent by or on behalf of CC Tree Design, LLC so you know who is contacting you.
2. Program Description (What We Use Texting For)
Our messaging program is used to communicate with clients and prospective clients about CC Tree Design services, including (as applicable):
Appointment and visit reminders
Scheduling confirmations and “on the way” notifications
Service updates and follow-up messages
Quotes, invoices, and payment reminders
Important service-related notices (for example, weather delays or access issues)
If you separately opt in to promotional communications, we may also send occasional marketing messages about our services, special offers, or company updates. Marketing messages are optional and are not required to receive services.
3. Message and Data Rates Disclosure
Message and data rates may apply.Your mobile carrier’s standard messaging and data rates may be charged for SMS/text messages sent to or received from us. CC Tree Design does not charge any additional fees for participating in our SMS/text messaging program, but you are responsible for any charges billed by your carrier.
4. Message Frequency (How Often We Text)
Message frequency will vary based on:
The services you request
Your active jobs or appointments with us
Whether you have opted in to promotional messages
You may receive multiple messages per service appointment (for example, confirmations, reminders, “on the way” notifications, and follow-ups), as well as occasional additional messages related to active or recent services. If you opt in to marketing texts, you may receive occasional promotional messages.
5. How to Opt In
You may opt in to receive SMS/text messages from CC Tree Design when you:
Provide your mobile phone number on our website or Jobber-powered forms and submit your information
Request that we communicate with you via SMS/text
Otherwise provide your mobile phone number and agree to receive text messages from us
By opting in, you confirm that you are the owner or authorized user of the number provided and that you consent to receive messages as described in these Terms.
6. Opt-Out Instructions (STOP)
You can opt out of our SMS/text messaging program at any time. To stop receiving text messages from us:
Text STOP to any message you receive from CC Tree Design, LLC.
After we receive your STOP message, we may send a one-time confirmation text to let you know that you have been unsubscribed, and then you will no longer receive SMS/text messages from that program, except where otherwise permitted or required by law.
If you prefer not to use SMS/text at all, you can contact us and request that we communicate only by phone or email.

9. Eligibility and Your Responsibilities
By using our SMS/text messaging program, you represent that:
You are at least the age of majority in your jurisdiction
You are the owner or authorized user of the mobile phone number you provide
You will promptly notify us if you change or discontinue your mobile phone number
You agree not to use our SMS/text messages for any unlawful or abusive purpose and not to interfere with or disrupt our messaging program.
10. Service Availability and Disclaimers
Our SMS/text messaging program is provided on an “as is” and “as available” basis. Message delivery may be affected by your mobile service coverage, your carrier, or other factors outside our control. We are not responsible for any delays, failures, or misdirected delivery of any messages, or for any actions taken or not taken by you or any third party in reliance on messages we send.
11. Limitation of Liability
To the fullest extent permitted by law, CC Tree Design, LLC and its affiliates, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your participation in our SMS/text messaging program. Where liability cannot be excluded, our total liability in connection with SMS/text messaging will not exceed the amount you have paid us, if any, for the services that gave rise to the claim.

We may update or modify these Terms from time to time to reflect changes in our practices, services, or legal requirements. Any changes will be posted on this page with an updated “Last updated” date. Your continued use of our SMS/text messaging program after changes are posted constitutes your acceptance of the revised Terms.
